Independence
of Judiciary is the essence of rule of law and basic structure of any
democratic set up. Slightest interference by political authorities in
appointment of judiciary erodes the fabric of trust in judiciary and violates
the concept of separation of powers. The foundation of judiciary is trust,
which if shaken, collapses the system.
The
Collegium system was introduced to ensure zero interference by strong executive
in appointment of judges and at the same time to ensure selection of the best
judges on merit by the Best and senior judges of the country. The sanctity in
appointing the judges was left to the wisdom and integrity of judiciary.
